Some Italian companies operating in the French cannabis market have reported issues with the seizure of goods by customs. In fact, France has its own interpretation of the law regarding the production and marketing of legal cannabis.

Cannabis is also a popular product in France. So much so that the country ranks first in the list of the largest cannabis consumers in Europe, despite strict enforcement and ultra-prohibitive laws on the matter.

Paradoxically, France remains the largest producer of hemp in Europe with over 17,000 hectares cultivated according to the European Industrial Hemp Association. In second place, we find Italy with 4,000 hectares and the Netherlands with 3,833 hectares cultivated.

These three countries produce more than half of the beautiful green in Europe, with a global increase of 3.3% in area between 2017 and 2018, reaching 50,000 hectares of hemp in Europe.

Since 2017, a multitude of shops specializing in the resale of cannabis-based products have opened across France.

Faced with this green tide, the State, which had no intention of legislating on the issue, reacted through the MILDECA, or the “interministerial mission for the fight against drugs and addictive behaviors.”

Consequently, the institution, which has no decision-making power, quickly issued a statement reminding that in France, cannabis flowers are prohibited and therefore cannot be marketed.

Indeed, French hemp workers have been destroying hemp flowers for decades because they are banned. Only the use of seeds and stems of industrial hemp is allowed.

However, in Europe, hemp flowers are permitted. This poses a uniquely French problem in the enforcement of European laws, including the free movement of goods between different countries in the community.

It is clear that with this legal fraud, French cannabis shops face two perspectives:

The one of the prefect, who decides whether or not the legality of the flower
That of the judge who rules on the case, to whom he will give his own view of the law.

That is why we find today shops that have been condemned (example here and here) and shops that are getting by (example here and here). This is why cannabis companies in the Alps, which are primarily online today, need flowers from abroad. But how will customs react?

Sandra d’Alessio is the director of New Moon in Piedmont. The company exports cannabis-based products, including oils and especially flowers. For three years, she has started operating in the French market, reaching a remarkable rate of 200 kilos exported each week.

But recently, she has to deal with the issues listed above. Some of her orders have been blocked by the French authorities. We then joined Sandra, and she spoke to us about the current situation.

LC: Hello Sandra, can you explain what is happening with you?

SDA: Hello Les Cannabistas. Recently, French customs have stopped us and seized shipments. And this is happening all over France, from Caen to Marseille, including Nantes and Strasbourg.

Today, Metz and Gap have joined where the seizure is significant.So far, the total economic loss exceeds 160,000€. We can say that the situation is starting to become very complicated for our company.

LC: What do the authorities say?

SDA: That is the problem, so far, it is total silence.After the seizure, it was shown that it was not a narcotic substance, but nothing. Nothing has been returned.

Transport companies, particularly DHL, seem to intercept our packages and call customs. After the first seizures, GLS and DDP have blocked our shipments, even UPS. We no longer know how to work and export our products!

I called the offices of both companies and French customs, and I must say I was very poorly received.I had to face agreat lack of motivation toresolvethis problem.That is whyI decided to seek help from lawyer Vecchioni in Nice and to appeal to a private transport company in Belgium.

LC: What will happen now?

SDA: Perhaps they will do further analyses, which could be problematic, as we do not know how the product is stored. We generally keep it cool to prevent the THC level from rising. However, I trust lawyer Vecchioni to ensure that things go well.

I must add that I am very surprised and angry to be treated like a drug dealer. I have personally experienced the loss of a loved one due to overdose. We do not sell drugs; on the contrary.

Thanks to cannabis sales, we have been able to donate over 8,000€, as well as numerous CBD products, to the San Giovanni Bosco hospital where I often go for renal failure. We also planned to buy a medical vehicle, but now that cannot be done.

LC: Hello “Master”, is the seizure suffered by New Moon legal?

VV: French law has a peculiarity that no other law has regarding hemp regulation.European texts state that all EU member countries have the right to market hemp and its derivatives as long as the THC level is below 0.2%. While France adds a parenthesis in its text aimed solely at fibers and seeds.

What does this parenthesis mean: exclusion or exclusivity?Which botanist could claim that flowers are not fibers?

The case is also defensible before the European Court, as France imposes restrictions from one member state to another, which is not in accordance with the Treaty on European Union.

LC: What about the analysis?

VV: There are community methods for analyzing the THC level in the plant. They are clear, simple, and comprehensive. It will be my duty to ensure that everything has been or will be respected to the letter.
